Um die vergaberechtlichen Bindungen zu umgehen, werden in der Beschaffungspraxis viele Methoden angewandt; eine davon ist das sogenannte Open-House-Verfahren. Dieses Vertragsmodell hat sich nicht zuletzt im Bereich der Arzneimittelrabattvereinbarungen etabliert, wo heutzutage mehr als jede dritte im Wege eines Open-House-Verfahrens abgeschlossen wird. Eine in einem solchen Verfahren abgeschlossene Arzneimittelrabattvereinbarung war Gegenstand der EuGH-Urteils vom 02.06.2016 in der Rechtssache „Falk Pharma“, in der sich der EuGH erstmals und grundlegend zu Open-House-Verfahren äußerte. Der europäische Gerichtshof hatte sich mit der Frage auseinanderzusetzen, ob eine Auftragsvergabe nach dem Open-House-Modell zwingend dem Europäischen Vergaberecht unterfällt, und, falls dies nicht der Fall sein sollte, welche Anforderungen an ein vergaberechtsfreies Zulassungs-verfahren zu stellen sind.
